Terms and Conditions

Your participation in The Wellness Report is subject to these Terms and Conditions, as may be amended from time to time. Definitions:

In these Terms and Conditions, we use several words that have specific meanings. “Personal Information” is any information that can be used to personally identify you, such as name, address or date of birth. “De-personalized” information is information that has had all Personal Information removed so that the identity of the person cannot be determined from the information. “Aggregate” information is a collection of De-personalized information from one or more sources.

1. What is The Wellness Report?

The Wellness Report (“The Wellness Report”) is a collaboration between The Manufacturers Life Insurance Company (Manulife) (hereinafter “we” or “us”) and Deloitte Inc. Deloitte Inc., along with Manulife, have developed this survey, and Deloitte Inc. is analyzing data and determining organization results. The purpose of the survey is to create awareness around employees’ health – physical, psychological, financial and organizational health and wellness, as well as the connection between individual and organizational health – by using specific lifestyle and wellness indicators and based on the survey responses. We aim to get a better understanding of the risks to Canadian organizations on a longitudinal basis, as well as to understand how the workplace can be used to change the health and lifestyle behavior of employees.

Deloitte Inc. is the data collection partner chosen by Manulife to administer, collect and analyze the information from organizations and employees in Canada.

2. Who can participate?

You must be at least 18 years of age, have a valid and unique email address, and internet access, in order to participate. The Wellness Report participation is limited to employees of organizations to whom Manulife provides Group Benefits or Group Retirement Plans.

Additionally, to protect your privacy and confidentiality, The Wellness Report is only available to organizations with 25 or more employees. Participation is free, and completely voluntary.

3. How to participate

By accepting these Terms and Conditions and consenting to the use of your personal information for the purposes set out here, you will be given access to the Employee Survey for your employer. Upon completing the full Employee Survey, you will be asked to enter your email address.

4. Use of The Wellness Report

As a condition of your use of The Wellness Report, you warrant to Manulife that you will not use The Wellness Report for any purpose that is unlawful or prohibited by these Terms and Conditions. You may not use The Wellness Report in any manner that could damage, disable, overburden, or impair The Wellness Report.

5. Outcomes and Reports

Once you complete the Employee Survey, you will receive a Personal Health report. The report shows results based on your survey responses, covering your physical, psychological and financial health, and recommendations to help improve your health. The Personal Health report is for informational purposes only and is not providing medical, nutritional, mental health, financial, fitness or other advice, for which individuals should seek appropriate professional advice.

To generate an Organizational Health report, a minimum of 25 employees must participate in The Wellness Report survey. This helps preserve your privacy and confidentiality. The Organizational Health report is based on all employee responses to the Employee Survey. It offers insights into five key dimensions of holistic health and wellbeing including physical, psychological, financial and organizational health and wellness, as well as the connection between individual and organizational health. The comprehensive results can help your employer assess your current work environment and wellness support needs. Only De-identified and Aggregate information is included in the Organizational Health report.

6. Release and Waiver

By using The Wellness Report, you acknowledge that you are doing so voluntarily and with the understanding that Manulife and its partners, affiliates, subsidiaries, employees, directors, and agents are not providing you with medical, nutritional, mental health, financial, fitness or other advice, for which individuals should seek appropriate professional advice. To the maximum extent permitted by law, we accept no liability in this regard.

You understand that the provisions contained in this Release and Waiver is contractual and not a mere recital, and you have read it fully. You hereby acknowledge that you understand and voluntarily accept it and all other Terms and Conditions contained herein.

7. Intellectual Property

Unless otherwise indicated in respect of another person’s trademark, we are the owner or licensee of all rights, title, and interest in and to The Wellness Report, including any intellectual property rights therein. Intellectual property rights include, without limitation, copyright, patent rights, industrial design rights, trademark rights, and confidential information. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse-engineer, disassemble, or otherwise attempt to derive source code from The Wellness Report.

8. Communications by Electronic Means

You consent to engage in electronic communications with Manulife, including but not limited to online and/or electronic mail. You also consent to engage in electronic communications with Deloitte Inc., including but not limited to online and/or electronic mail. We will generally provide you with information about The Wellness Report through the email address you provide when you register. We may also provide information about The Wellness Report through your employer.

9. Your Information and Your Privacy.

Your privacy is important to all those involved in The Wellness Report. We shall adhere to applicable laws regarding privacy and the protection of personal information, and shall maintain appropriate administrative, technical, and physical measures to safeguard and secure your personal information.

Information submitted through the Employee Surveys will be used for the purposes of conducting The Wellness Report including the review, analysis and production of reports for participating organizations and employees, and for research purposes. Responses are kept confidential. All information that you provide which can be used to identify you will be considered Personal Information. Any electronic transmission of individually identifiable data will be encrypted.

We may use the results derived from Aggregating all responses and these results may be made publicly available via reports and research articles and may be combined with Aggregate data collected by the participating organizations. Aggregate data gathered from participants may be collected and used by us to develop future survey materials, as well as additional products and services. 

In the course of administering The Wellness Report, the following organizations will be collecting, using, and sharing my Personal Information, in the following ways:

Deloitte Inc.

Responses to all surveys will be collected by Deloitte Inc., in Canada. All employee responses, including all Personal Information of employees (such as email addresses), will be stored on confidential servers. All information is gathered, used, stored and disclosed in accordance with Deloitte Inc.’s Privacy Policies, as updated from time to time and available at https://www2.deloitte.com/ca/en/footerlinks1/privacy.html. With your consent, Deloitte Inc. may disclose limited Personal Information of participants to Manulife to allow Manulife to administer participation-related benefits or incentives on behalf of your employer.

By participating in The Wellness Report, you consent to the collection, use, and sharing of your Personal Information by Deloitte Inc. for the purposes set out in these Terms and Conditions.

Manulife

Manulife collects, uses and discloses all information it receives, including the Confidential Information of participating organizations and the Personal Information of employees, in accordance with its Privacy Policies, as updated from time to time.  

Manulife will receive De-personalized information, based on the Employee Surveys, from Deloitte Inc. Manulife will also receive the Organizational Health reports from Deloitte Inc. With your consent, Manulife may receive limited Personal Information from Deloitte Inc. to allow Manulife to administer participation-related benefits or incentives on behalf of your employer. This information shared with your employer will be limited to the information necessary to administer participation benefits, and will not include any information about your physical, mental or financial health. Manulife will not share the De-personalized information, and if applicable, the limited Personal Information it receives from Deloitte Inc. with any other organization. Organizational Health reports will be shared with the relevant employer.

Manulife’s Privacy Policy applies to the use of The Wellness Report, and its terms are made a part of these Terms and Conditions by this reference. 10. Data Held In Canada

Your information will be gathered and stored in Canada.

11. Terms of Use and Cookies

To participate, you must consent to the use of cookies on the survey websites and agree to be bound by Deloitte Inc.’s Terms of Use of their websites.

12. Disclaimer and Limitation of Liability

We disclaim all express, implied, and statutory warranties including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement of proprietary and intellectual property rights, and any warranties regarding the security, reliability, accessibility, timeliness and performance of The Wellness Report.

We believe that the information included in The Wellness Report is accurate when it is made available in The Wellness Report. You understand and agree that we cannot, and do not, guarantee nor ensure the accuracy, completeness or authenticity of The Wellness Report’s contents, functionality, or your transmission of any information or instructions to or from The Wellness Report. You use The Wellness Report at your own discretion and risk. You agree that in no event will we, or our affiliates, agents, licensors, suppliers, officers, directors, employees, contractors or agents be liable to you or any other person for any harm, loss or damages whatsoever that may arise in connection with your use or misuse of The Wellness Report or that s any use or misuse of The Wellness Report however so caused.

You understand that the availability of The Wellness Report to you may be governed in part by your employer's contractual arrangements with us, if applicable, and your continuing membership in the plans or policies, which may change from time to time.

The Wellness Report is only available in jurisdictions where it may be legally provided. Nothing contained in The Wellness Report constitutes an offer or solicitation to anyone in any jurisdiction in which the content or operation of The Wellness Report is not permitted by law.

13. Indemnity

You agree to indemnify and hold Manulife, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries, and affiliates harmless from any demands, loss, liability, claims or expenses made against Manulife by any person due to or arising out of or in connection with your use of The Wellness Report or your breach or violation of any of these Terms and Conditions.

14. Termination, Suspension or Inability to Access

Manulife reserves the right, in its sole discretion, to terminate your access to The Wellness Report or any portion thereof at any time, without notice. Manulife reserves the right to terminate any or all of the services provided in connection with The Wellness Report at any time without notice. Manulife will have no liability for any damage that may arise as a result of such termination.

Any or all of the services available to you through The Wellness Report may periodically be unavailable to you in order to allow for maintenance, updates, or other reasonable causes, including causes beyond Manulife's control.

15. Governing Law

The Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law.
